The Oklahoma attorney general is asking the U.S. Supreme Court to weigh in on the case of Karl Fontenot.

Fontenot was featured in the Netflix series and John Grisham book, “An Innocent Man.”

Back in August, the 10th Circuit Court of Appeals upheld a lower court’s ruling that Fontenot be re-tried for the 1984 kidnapping, robbery and murder of Denise Haraway.

Attorney General John M. O'Connor asked for a full panel of 10th circuit judges to hear his appeal, but the 10th circuit denied that motion on October 6.

On Tuesday, O'Connor filed a motion in federal court for SCOTUS to stay the order to retry Fontenot within 120 days.
