A mother whose son was gunned down New Year's Day, in Midtown Oklahoma City, is calling on the Oklahoma County District Attorney’s Office for answers after she says two of the three defendants charged in her son’s case got off too easy.

According to court filings, one of the defendants walked out of jail last week, and as long as she can stay out of trouble she won’t be forced to return.

Records also showed another defendant pleaded down to a lesser charge.

The victim’s mother told News 9 she was blindsided after the District Attorney’s Office failed to notify her.

“I have to find out through Googling it on what's going on with my son's case,” said Stephanie, Daniel Howard’s mother.

January 1, just hours after Daniel Howard, a football standout, left his parents’ home his mother Stephanie got the call.

“My son's girlfriend's mom called me and said Daniel has been shot,” said Howard.

Scrambling to go to their youngest child, Daniel’s parents learned it was too late.

“Death is part of life, we all just have to figure out our healing process. We'll never get over it,” said Howard.

J’coal Glover, Khalil Warren, and Destiny Adams were all charged.

Police said Glover provided the gun, Warren fired it, and Adams drove the getaway car and disposed of evidence.

While Warren remains jailed on multiple charges including first-degree murder, records showed Glover's charge for first-degree murder was reduced to accessory to murder.

Meanwhile, Adams walked out of jail last week after being sentenced to 5 years’ probation for accessory to murder.

In exchange, she'll be forced to testify at trial.

“I’m not for sure what the max or minimum for something like this would be, but I’m pretty sure its more than five years’ probation,” said Howard.

Howard said she planned to return to the courthouse with friends and family this week in hopes of visiting with the district attorney.

“I just wish the case would be handled as if this was their own child, not just looking at him as a case number,” said Howard.

In a statement, a spokesperson from the Oklahoma County District Attorney’s Office told News 9 in part “The Victim Witness Center can help families to schedule a meeting with the prosecuting attorney…”

and “that it is important for the individual who pulled the trigger to be prosecuted for 1st-degree murder.”
