Affidavit Reveals New Details On Suspect Accused Of Trying To Solicit Sex With Toddler

A man accused of trying to solicit sex with a 2-year-old was texting the toddler's mother to convince her to bring the child to his apartment, according to an affidavit filed in Oklahoma County District Court.

A man accused of trying to solicit sex with a 2-year-old was texting the toddler's mother to convince her to bring the child to his apartment, according to an affidavit filed in Oklahoma County District Court.

The affidavit stated that the child's mother met 32-year-old Michael Overby while she was working as a dancer at an Oklahoma City bar. 

While she was typing Overby's number into her cell phone, Overby noticed a picture of the woman's 2-year-old daughter on her screen saver, the affidavit said.

According to the woman, Overby then commented, "Oh wow, she's beautiful. How old is she?" 

The woman told investigators that on March 12, Overby texted her, "Do you allow sex with your daughter?"

The affidavit said the text exchange then continued like this:

Woman: "My phone is messing up. Who's this?"

Suspect: "Michael O. We met at Red dog."

Woman: "Ohh, yeah! We'd have to talk in person. Delete these as well."

Suspect: "Okay."

Woman: "When could you come see me again?"

Suspect: "I actually have a cold right now so I'm stuck at my apartment. After I recover, I can come in and see you. I got a new job at ... working Monday through Friday 10:30 to 5. So maybe not until next Sunday. I can host at my apartment. But we can talk about that when I come see you?"

The woman reported the incident to an investigator with the Cleveland County District Attorney's Office, who then informed Oklahoma City Police.

On March 16, police met with the woman, who agreed to contact Overby again, the affidavit said. 

In the text message, the woman said she was considering Overby's offer, but wanted to know what he planned to do with her daughter.

The affidavit said the next morning, Overby replied with the following message:

"Thanks for considering it. Of course, I would never do anything to physically hurt anyone and I definitely would not ever have a thought to kill anyone."

The text message then described specific sex acts that News 9 omitted due to the graphic nature. 

Overby continued his message with the following, according to the affidavit:

"Of course you are welcome to stay in another room if that is what you would like to do. I have a one bedroom apartment if you would like to watch a movie in the living room or I have an Xbox and Nintendo Switch (sic) if you'd like to have something to do..."

Overby also asked the child's mother if she'd like to join in on the sex act, according to the affidavit. 

He ended his message by allegedly asking the woman, "What would be a fair price for you?"

Police arrested Overby on Monday. He faced possible charges of lewd acts with a child and violation of the Oklahoma Computer Crimes Act. Overby was being held on a $200,000 bond at the Oklahoma County Detention Center. Due to the charges, Overby was in protective custody, an investigator said. 

Police said they planned to continue looking through the suspect's phone and computer.
