The Oklahoma City Police Department is investigating a homicide from Monday night on SW 38th and S. May Ave.

It happened before 7 p.m. MSgt. Gary Knight confirms two cars were involved. He said they were chasing each other when the victim's car crashed into the pole of a gas pump.

"It crashed into a pole there and that was when the victim got out, approached the suspect or suspects, and that is when he was shot,” said Knight.

Police found a male victim inside the crashed car when they arrived on scene. He was transported to the hospital where he was pronounced dead.

A grieving mother tells News 9 her son was the person shot. She got a call that no parent ever wants to receive. She said her son's name is Jose Rubio and he was 19 years old. He has two little sisters, one 6 and one 15.

During the interview, the 15-year-old sister translated for her mom. She said, "She wants people to help find who killed my brother. No matter what the reason, it's not fair that he took the life out of him."

Police are still waiting to confirm the victim's identity. Anyone with information about the homicide is asked to contact OKCPD's homicide hotline at (405) 297-1200.

The family is asking for help with the funeral. If you’d like to contribute, contact Morelia at (405) 430-4807.
