NORMAN, Oklahoma -- A Cleveland County judge today ordered 15-year-old Brittany Herrera and 18-year-old Matt Fox to stand trial for the stabbing murder of Herrera's father, Leroy, last January.
Herrera's attorney argued the girl should be certified as a juvenile.
"We had hoped that (the judge) might entertain a bind-over for a lesser included offense," said defense attorney David Smith. "She definitely could have been able to be certified."
But Judge Michael Tupper said state law was clear that a 15-year-old could not be certified as a juvenile.
No trial date for the pair has been set.
