OKLAHOMA CITY -- The attorney for an Oklahoma City pharmacist accused of using excessive force when he killed a 16-year-old would-be robber has filed a re-hearing of his motion to have the judge in the case removed.

Last week Judge Ray Elliott said he would not step down from the Jerome Ersland murder case.

Defense attorney Irven Box said his new motion will be heard by Judge Graves. The hearing for that motion has not been set.
