Witnesses say Grant convulsed and vomited on himself before the paralytic was administered during the execution.

"Inmate grant's regurgitation was not pleasant to watch but I do not believe it was not inhumane because at the point in time he was regurgitating the physician who was monitoring the process says inmate grant was indeed sedated," ODOC Director Scott Crow said.

"In these situations, where something goes wrong during an execution, departments of correction typically respond by saying 'nothing to see here.' 'Everything went according to protocol.' Having a prisoner convulse and vomit, to me, doesn't seem like it fits within the Oklahoma protocol," Federal Public Defender Dale Baich said.

The sedation in question, Midazolam, is at the center of a legal battle over the state's three-drug injection protocol. The trial is set for February.
