MARLOW, Oklahoma -- An Oklahoma judge ruled the Stephens County District Attorney must step aside in a perjury case involving a former Marlow police officer.

The decision from Jackson County District Judge Brad Leverett was handed down in Stephens County Wednesday.

Judge Leverett told D.A. Bret Burns he could be a potential witness in the case against Rodney Wayne Richards, therefore another district attorney's office will be asked to take over.

"I don't agree with this and my office is considering an appeal," Burns said.

A hearing scheduled for Friday has been delayed due to these new developments.
