Brother Of OC Graduate On Board MH 370 Suing Airline

Malaysian Airlines Flight 370 disappeared two years ago and still has not been found. The airline is now being sued by the brother of an American man on board.

Oklahoma Christian graduate Philip Wood boarded Malaysian flight 370 in Beijing en route to Kuala Lumpur. His family hasn't heard from him since that day in March 2014.

Bloomberg reports his brother Thomas Wood is now suing Malaysia airlines for his brother's death. This is the first lawsuit filed by the families of the 239 on board. Thomas Wood is seeking nearly $156,000 under the terms of a convention that establishes airline liability in the case of death.

According to the lawsuit Wood could also receive more money, unless Malaysia Airlines can prove his brother’s death was caused by something other than the negligence of the carrier or its employees.

Last year, Investigators concluded that someone on board intentionally disabled the aircraft's tracking devices, and the jet turned south before plunging into the Indian Ocean off Australia's western coast.

The airline has declined to comment on the lawsuit.
