A metro man was caught in the act of taking upskirt photos of women shopping at the Walmart on West Reno.

The report states, Kevin Bierig, 44, told officers his attorney told him taking the photos is not illegal as long as he is in a public place.

“First of all, that’s disturbing,” said Marisol Mejia, shopper. “I would feel very mad that they said they could do that because he’s violating my rights.”

Police said Bierig violated at least three unsuspecting women. Several customers witnessed Bierig's inappropriate behavior and notified store security.

“He would act as if he dropped something,” said MSgt. Gary Knight, Oklahoma City Police Department. “Or bend down and snap an inappropriate photo.”

A security guard also witnessed Bierig following a female shopper and reported the man bent down and took a photo under the woman's dress. The security guard confronted Bierig and held him for police.

When officers arrived, they asked to look at his phone, but the accused peeping Tom refused to hand it over.

The report states Bierig acted very nervous and continually begged the officers to let him go. Police asked one of the victims if she was aware he took a photo of her and she said no, but did notice him following her in the store.

More than one female shopper expressed concern that the photos were taken without the women even knowing.

“It’s not safe for anybody,” said Mejia. “Especially anybody in the store.”

Bierig was arrested and booked into jail on one Peeping Tom complaint, even though the accused man thought what he was doing was perfectly legal in a public place.

“To be clear, it’s not,” said Knight. “That’s something you go to jail for.”

Police also watched the store's surveillance video and saw Bierig following a woman very close and holding out his phone.
