Richard Glossip's Attorney Responds To OK Co. DA's Strong Words

The execution of Richard Glossip is scheduled for Wednesday afternoon, but late Tuesday, his attorney filed a 34-page document with the Court of Criminal Appeals.

It lays out several points as grounds for an appeal.

Glossip is twice convicted in the 1997 murder of Barry Van Treese at an Oklahoma City motel.

The appeal is an effort to save Glossip's life, and his attorney reacted to strong words from Oklahoma County District Attorney David Prater.

“This is crap,” Prater said. “This is a bull**** campaign. That’s all it is."

Late Tuesday afternoon, Glossip's attorneys filed an appeal. Attorney Don Knight said his team has been working nonstop, uncovering new evidence.

“We can’t just give a little bit here and a little bit there,” Knight said. “We have to present all of that evidence at one time, and that’s what we did today.”

“It’s just a delay tactic,” Prater said. “These are the games we see in these cases.”

"If we had a trial again tomorrow with our new evidence we would win. We would not only not get a death penalty, but we would get a not guilty verdict,” Knight said. “That's how powerful this new evidence is."

Evidence Prater said he never saw.

“Why have I not had those? Why did they not send them to me? Why did they not send them to the governor’s office? How are you asking Gov. Fallin to make such an important decision, and you’re keeping her in the dark?” Prater said.

“David Prater knows that that’s not how the system of justice works,” Knight said. “He doesn’t give me his witnesses before trial.”

Tuesday, Fallin released a statement, stating, "My office and I have urged them to bring that so-called evidence to the proper venue: a court of law. Not only have Glossip's lawyers not done so, but they have actively rejected requests from public officials to examine whatever materials they have."

“American justice works in a court,” Knight said. “Give me a court.”

“You want to do something in the courts? Let’s do it in the courts,” Prater said.

The appeals court has Glossip's petition, will review it and will determine if enough evidence has been presented.

If a stay is not issued, Glossip will be executed Wednesday afternoon.
