DUI Arrest Leads To Child Porn Charges For Ada Man

A man is arrested for driving under the influence, but what was discovered on his phone after his arrest now has him charged with making child porn.

The victim is just four years old, and to protect her identity, her mother’s face is not visible and their names are not used.  

"Today she was very clingy and cried so hard,” the little girl’s mother said.

Thursday was the first day of school for a lot of kids, but for this child it was more than first day jitters.

"It was a bittersweet day,” her mother said. “Because I know she's not just crying like the normal kid."

This mother speaks in silhouette, but her four-year-old daughter is now living with a shadow that will haunt her for the rest of her life.

The dark secret came to light when this woman's former boyfriend, Joshua Nemecek, was pulled over for driving under the influence. Police let his friend drive his truck home. That friend suspected Nemecek of having an affair with his wife. When he found Nemecek's phone inside the vehicle, he went through it. Instead of finding evidence of an affair, he found numerous pornographic pictures of a little girl and called police.

"It was the worst nightmare you could ever imagine,” her mother said.

Now the girl's mother is giving a voice to that nightmare, but the images she can't bring herself to look at yet. Hindsight is always 20-20. The signs were there.

"He started sleeping on the couch in the living room,” she said. “He always made me keep my bedroom door shut, because he didn't like my cat going in the room. So therefore, he would just go in my daughter's room at night, and I didn't know. I never had a clue."

The two were engaged to be married.

"We had been together almost three years, living together,” she said. “She called him daddy."

Now they are separated by this and a protective order.

"The thought that I was lying beside this man who went in the room and was doing those things,” she said. "It's horrible.

Nemecek was charged with soliciting a minor to make child porn, possession of child porn and two counts of forcible oral sodomy.
