Wagoner County Sheriff: Stillwater Man Killed After Breaking Into Home

WAGONER COUNTY, Oklahoma -

A 38-year-old Stillwater man is dead after getting into an altercation while breaking into his ex-wife's new home in Okay early Wednesday morning, according to the Wagoner County Sheriff's Office.

Deputies say the Michael Smith was climbing through the kitchen window when a male guest in the home got into an altercation with Smith.

"It's 2 o'clock, 3 o'clock in the morning, you hear glass breaking and it's your ex-husband, you know that's gonna be pretty bad for anybody, whether they're just visiting the residence or not," said Sheriff Bob Colbert.

Colbert said Michael Smith had only been divorced a few months when he showed up at his ex-wife's new home.

Colbert said there were two men inside when Smith crawled through a kitchen window.

"When this started, she went and hid in the house and one of the males is the one that got in the altercation with him," Colbert said.

The altercation ended with Smith being stabbed to death.

Colbert said that altercation led to Smith being stabbed - he was dead when deputies showed up to the home.

Smith was charged in Payne County with domestic assault and battery against his mother back in May.

The affidavit states that Smith abused his mother, took her phone, and then told her he would kill her if she called anyone.

Colbert said Smith's ex-wife filed a protective order against him, but the sheriff isn't sure if it was still in effect.

He also couldn't say for sure why Smith showed up in the first place.

"We probably have seven or eight more witnesses we need to talk to, if there was anything planned or anything, if he told anyone he was going to the residence or what," Colbert said.

Colbert said deputies did not find any weapons on Smith.

He also said it's too early to tell if any charges will be filed for the death.
