"Right now, investigators are trying to figure out who was in the house and what led to the tragic incident," says Sgt. Gary Knight with OKCPD.

Police had originally said the three-year-old was alone inside his apartment with his father.

Sgt. Knight says investigators won't say if this is an accident until getting a report back from the medical examiner.

Meanwhile, neighbors are still shaken up by the incident.

"The body was next to the bed. I couldn't stick around. I have a daughter that age and it messes with your head," says Charles Frazier who lives next door and tried to help the father.

"He was emotional he was hysterical," says Frazier.

Davian's family says they are now making funeral arrangements. They tell News 9, Davian's death was a horrible accident.
