Report expected on sheriff rape case

The Oklahoma State Bureau of Investigation is expected to release a report on whether a Custer County sheriff raped a drug court participant while she was in his custody.

The Oklahoma State Bureau of Investigation is expected to release a report on whether a Custer County sheriff raped a drug court participant while she was in his custody.

The woman reportedly told OSBI that she and Sheriff Mike Burgess of Arapaho had sex multiple times in his home. Under state law, a prisoner cannot consent to sexual relations with a jailer or someone else who controls the conditions of the prisoner's confinement.

No criminal charges have been filed against the sheriff.
