Medical Proof Will Exonerate Martinez, Attorneys Say

OKLAHOMA CITY -- He's accused of molesting his foster kids, but attorney's for Maurice Martinez say they have medical proof it didn't happen.

The former Oklahoma City Police Sergeant is set to go to court on Monday.

On Friday, Martinez's attorneys filed a motion asking for their client to be released on bond.

They say new evidence has just become available to them that proves the allegations are false.

A significant portion of the several page motion includes a report from Dr. Richard Kishur who preformed a psychosexual evaluation on Martinez.

"That testing shows Mr. Martinez has no interest in boys or men. We think that's important and significant because all the allegations involve boys," said David Slane, Martinez's attorney.

Martinez has been held without bond since April when police say he was harboring one of his foster children who ran away from D.H.S.

Court papers filed Friday say that child and almost all of the other's Martinez has fostered deny any sexual abuse.

"We expect them to take the stand and say none of this stuff happened, with the exception of one who all the other boys say is a habitual liar," said Slane.

That would happen on Monday when prosecutors present their case against Martinez during his preliminary hearing.

The former Police Sergeant faces several charges including kidnapping, harboring a runaway juvenile, seven counts of sexual abuse and two counts of forcible sodomy.

"We fully expect most of these charges to be dismissed, if not every single one of them," said Pat Crowley, another one of Martinez's attorneys.

District Attorney David Prater said he couldn't comment on this recent motion because he hadn't seen it yet, but his office will vigorously oppose any attempt to grant Martinez Bond.

That preliminary hearing is scheduled for 9 a.m. Monday.

A judge has yet to schedule a time to hear the bond motion.
