A toddler is hospitalized from possible abuse and her mother is charged with the crime.
We first introduced you to the little girl doctors said may never walk again back in April. Now we are learning the mother's boyfriend is also charged with the crime.
A birth defect put Braylee Hinkle in the hospital several times during the first year of her life. But investigators suggest this last trip to the ER came at the hand of not only Braylee's mother, but court documents show detectives believe the mother's boyfriend also played a part.
Braylee Hinkle is only a year old and already been through more than most adults. In April 2012, the toddler arrived to the hospital with countless bruises. Court documents indicate. Doctors also found broken arms ribs and legs and warned Braylee may never walk again.
Deputies arrested Braylee's mother, Kayla Pollock, who is charged with child abuse. Documents show investigators noticed Pollock send numerous text messages while doctors reviewed Braylee at the hospital. A search of Pollock's phone would lead detectives to Pollock's boyfriend, Cody King.
A search of King's phone records reveals multiple text messages sent between the couple.
King writes, " (child) will never get better and you won't nail her for acting up,"
In additional text messages King says," dont be talking to those dumb**** about bruises." and goes on to say," she is getting worse and we won't get along if you don't. It's your choice discipline her or lose us all."
Two weeks later, Braylee is in the emergency room, Pollock is arrested and King writes," well you better not get into pressure and rat me out to save you I'm serious."
The Major County District attorney filed a child abuse charge on King.
Pollock is due in court this week for her one count of child abuse.
Braylee is currently in DHS custody. Her paternal grandmother tells us she is recovering from the injuries, and is hopeful Braylee will be able to walk with a brace in the future.
In addition to the child abuse charges, text messages also provided evidence for prosecutors to file charges on Cody King for insurance fraud.
