Cleveland County prosecutors charged a 20-year-old old man with first-degree murder Wednesday for the death of 57-year-old Mary Ellen Benavidez.

Dustin Allen is accused of killing Benavidez in her home near Flood and Robinson on September 13. According to new court documents, Benavidez's son was walking back to the home around 4 a.m. when he heard a gunshot. He told police he then saw Allen run through the yard, get into a Dodge Caliber and drive away from the scene.

Benavidez's son said he went into the house and found his mother lying on the kitchen floor with a gunshot wound to her chest. She later died at a hospital.

Police arrested Allen after a police chase in Oklahoma City. According to a probable cause affidavit, Allen told investigators he was angry with Benavidez's son, so he went to the house looking for him. He allegedly admitted he took a gun with him, and kicked in the front door.

Allen reportedly said Benavidez confronted him, and that's when he shot her once in the chest.
