Metro Fitness Challenge Official Rules

1. THE CHALLENGE:
The rules of this Challenge are governed by and interpreted in the discretion of Griffin Television Oklahoma City, L.L.C. ("KWTV"), their parent company, any subsidiary or other related entity (collectively, "Griffin").  A panel of representatives from KWTV and some participating sponsors will select two families (the "Participants") from the Oklahoma City metropolitan area to compete in a weight loss challenge between the dates of February 27, 2008 and May 14, 2008 (the "Challenge").  Participants will compete in weekly challenges. At the end of the Challenge, the family that has lost the largest percentage of weight over the course of the competition (since the beginning of the Challenge) will win the Grand Prize of $2000 cash and a Life Fitness exercise bike. The competition (since the beginning of the Challenge) will win the Grand Prize of $2000 and the exercise bike from Fitness Equipment World.  The percentage of body weight lost by the family as a whole over the course of the entire competition will be determined by the total starting weight of those same two adults [(combined weight at beginning - combined weight at end) divided by combined weight at beginning].  The 2nd place family will win one year's free membership to Integris Pacer Fitness Center.  The total cash value of the family membership is $1200.

Weight-loss parameters will be suggested for each individual at the beginning of the Challenge by doctors chosen by sponsoring companies or Griffin.  Weekly challenges may be altered at Griffin's discretion.  Any prize awarded or earned during the competition does not become the property of the Participant until and unless he or she participated until the natural conclusion of the Challenge.

Participants acknowledge that entry information may be shared with promotional partners.  KWTV and participating sponsors are not responsible for lost, damaged, stolen, illegible, late or misdirected entries, or for any technical or human errors associated with the Challenge. 

2. REQUIREMENTS OF CHALLENGE PARTICIPANTS:

All Participants must comply with all terms and conditions of these Official Rules.  In addition to this rule sheet, the Participants may be required to sign, execute, have notarized and return certain documents including a waiver, consent, and release and any other documentation that the sponsoring companies require.

3. ELIGIBILITY:

Open families residing within the News 9 (KWTV-Oklahoma City) DMA, as defined by the Nielsen Station Index.  The Nielsen Station Index controls, however, this area is generally Oklahoma City and surrounding areas.  Void where prohibited or restricted.  Offer subject to all applicable laws. Employees of the sponsoring companies and members of each of their immediate families/households are not eligible to participate.

4. GENERAL CONDITIONS:

By participating, Participants agree (a) to abide by these Official Rules and the decisions of the sponsoring companies and officials, which will be binding and final in all respects; (b) to the use of information of whatever form including the biographic or demographic information or video and audio of the entrants by Griffin or the sponsoring companies for marketing and advertising purposes; (c) to identify, defend, and hold harmless Griffin or the sponsoring companies and their officers, directors, and employees from any and all liability, claims, lawsuits, costs expenses, fees, injuries, (including death), losses, and damages resulting from participating in the Challenge, acceptance or use of any prize, and/or from Participant's fraudulent or otherwise wrongful acts or omissions; (d) not to sue Griffin or the sponsoring companies for any damages arising from winner's acceptance of or use of the prizes; and (e) to the use of Participant's name, voice, biography, and likeness by Griffin or sponsoring companies without further notice or compensation for promotion, advertising, filming, and dissemination purposes, except where else prohibited by law.

Griffin shall have the sole right to disqualify any Participant for violation of these rules or any applicable laws relating to the Challenge, and to resolve all disputes in its sole discretion.  The sponsoring companies and Griffin (i) make no warranty, guaranty or representation of any kind concerning any prize, (ii) disclaim any implied warranty and (iii) are not liable for injuries, losses, or damages arising out of any person's participation in the Challenge.  All disputes will be resolved under applicable Oklahoma laws.  No substitutions are allowed except in the sole discretion of the sponsoring companies.  Griffin reserves the right, in its sole discretion, to cancel or suspend the Challenge for any reason.

All other costs and expenses not stated herein are not included and are the sole responsibility of the Challenge Participants.

Prize is not transferable and may not be substituted. Winner shall be responsible for applicable local, state and federal taxes.  Any fraud committed by a contestant in connection with this Challenge will disqualify that contestant and subject said contestant to possible legal liability.

5. DISCLOSURES AND ACKNOWLEDGEMENTS:

Each Participant agrees to allow Griffin to tape, film, and/or record his or her activities for use related to the Challenge.  Each Participant who is a parent, guardian, or custodian of a minor child aggress to allow that minor child to be a participant pursuant to the rules of this Challenge and/or have his or her activities taped, filmed, and/or recorded for use related to the Challenge.

6. GRANT OF RIGHTS/OWNERSHIOP OF MATERIAL:

In exchange for being allowed to participate in this Challenge, each Participant gives Griffin the exclusive and irrevocable right to film, videotape, and/or otherwise record each Participant and his or her children in connection with this Challenge for use by Griffin or participating sponsors.  Griffin will be the sole and exclusive owner of all such film, videotape, audiotape, or other recordings.

7. AWARENESS AND ASSUMPTION OF RISK:

Each Participant aggress to accept any and all risks attributable to his or her participation in the Challenge including, but not limited to, illness, personal injury, and/or property loss.  In addition, each Participant accepts and assumes any risk that is in any way associate with his or her participation in the Challenge and the taping, production, use, editing, distribution, promotion, or other dissemination of any recordings of or information provided about the Participant and waives, without limitation, any claims for negligence, personal injury, defamation, invasion of privacy, or infliction of emotional distress associated therewith.

8. CONSULTATION WITH PHYSICIAN:

Each Participant acknowledges that Griffin has advised him or her to consult with his or her own physician regarding the advisability from a physical and emotional health perspective of his or her participation in the Challenge and that he or she assumes the risk of any injuries allegedly caused by participation in the Challenge.  Each Participant agrees that he or she will not sue or otherwise hold liable the doctors, trainers, and the other health care professionals with whom he or she may come in contact during this Challenge are neither employees nor agents of Griffin and that Griffin is not liable for the actions of inactions of such doctors, trainers, or other health care professionals.  Each Participant acknowledges that he or she is not relying upon Griffin for any medical or health care advice.
