The Oklahoma Court of Criminal Appeals ordered a new trial because jurors were exposed to and discussed several jurors' personal observation of the crime scene in violation of the Trail Court's order.

According to the DA's office, the two victims in the case who testified about the incident desire to move on with their lives after college and not go through the trauma of testifying again. The DA says he respects their decision and has decided not to prosecute further.
