Oklahoma City Police confirm they have arrested Elijah Evans, 36, and Gilbert R. Terrel, 37, in connection with the murder of Joseph Martin, Sunday night. The two were booked into the Oklahoma County jail early Monday morning.

Martin’s family of the victim still can't believe he was shot and killed Sunday in an area that many people consider very safe.

“They shouldn't have done it to him,” said Jeffrey Martin, Joseph’s brother.

He still can't get over the loss of his little brother Joseph, and is brought to tears knowing he will never see him again.

“I think it was a setup to be honest,” said Jeffrey Martin.

Martin says Joseph was in the middle of a divorce and was with his girlfriend Sunday night.  She says she witnessed the shooting and can't believe she wasn't shot too.

“I got up and didn't look at him or anything. I just ran…and I dove off into the bushes,” said the girlfriend.

Just beyond the tree line, near the bike trails on Eagle Lane, is where Joseph Martin and his girlfriend had been staying for the past month. She says the random items and bikes around the camp were things they had collected while dumpster diving around town.

And it was a fight over one of their finds that she says appears to have led to the shooting.

“The first guy had the bike and didn't even see us, and the second guy came out and then Joe was like ‘Hey’,” said the girlfriend.

That's when she says Joseph got shot.

“He said, ‘You stole my vacuum’ and before Joe could even defend himself he just fired and shot him,” she said. “He just shot him.”

Jennipher Stevenson lives in the condos across the street from the bike trails and didn't hear the shot, but says a man came banging on her door to call 911.

“He said you need to call the cops, someone has been shot,” said Stevenson.

Stevenson says the man who knocked on the door identified Elijah Evans as the man who was responsible for the shooting. Police also arrested Gilbert Terrel. The two now stand accused of first-degree murder in the death of Joseph Martin.

Both Terrel and Evans are yet to be formally charged.

“He will be missed,” said Jeffrey Martin.

Funeral arrangements are pending. Joseph Martin leaves behind a wife and daughter.
