A former Luther city councilman, already charged over a copper theft scheme, is in trouble again.

James Smith has already been arrested and charged for ordering inmates to steal copper from Oklahoma County tornado sirens. But on Tuesday, Smith was arrested again for allegedly threatening two of the state's witnesses.

News 9 was there Tuesday afternoon as Smith was brought in to jail. Authorities say Smith ran one of the witnesses off the road with his vehicle. An affidavit says he also told a witness he was going to kill them.

Smith has since bonded out.
