Warner Police call the death of a pedestrian a tragic accident.

The chief of police says a driver was heading south on 3rd in a Dodge pickup at about 5:20 a.m. and didn't see the pedestrian.

The chief says the pedestrian, identified as Christopher Buchanan, was wearing a camouflage coat and listening to headphones as he walked to work at McDonald's. The driver was headed to McDonald's for breakfast.

The driver was issued a ticket for inattentive driving and a ticket for speeding, but the chief says alcohol was not involved in the incident as previously reported to the media.

Muskogee County EMS says Buchanan was pronounced dead at the scene.
