Judge Denies Chad Peery Attacker's Request To Withdraw Guilty Plea

On Friday, a judge denied a request to withdraw a guilty plea from one of three men who attacked and paralyzed Oklahoma City police officer Chad Peery in February 2011.

Cadmio Lopez entered a blind guilty plea in November 2011. In January, a judge sentenced him to 30 years in prison, 15 of which were suspended. Another suspect in the beating, Jimmy Smith, accepted a plea deal from the state. A judge sentenced him to 10 years in prison, and an additional 10 years probation.

Lopez's attorney argued he should be given the same sentence as Smith. Prosecutors said Lopez just wasn't happy with his sentence, and that's not grounds for a withdrawal.

The judge agreed with prosecutors.

Prosecutors said Lopez, Smith and Joshua Rinken severely beat Peery when he forced them to leave Dan O'Brien's Pub in Oklahoma City.

Rinken is also trying to get the same plea deal as Smith, but the Oklahoma County District Attorney's Office said the deal is now off the table.
