OKLAHOMA CITY -- Oklahoma County District Attorney David Prater said he will not file charges against an Oklahoma City police officer who hit and killed a drunk driver.
Officer John Paull was responding to a larceny in progress at 5:30 a.m. July 29, when a he struck a car driven by 49-year-old Raul Becerra.
Prater said Becerra was intoxicated and ran a stop sign at S.W. 29th and Indiana, causing the crash.
"In this case, the drunk driver died, and that's tragic for those who love him and his family. But it's unfortunate he put himself in that position," the district attorney said.
Prater said Becerra's blood alcohol level was above the legal limit, and he had two unopened beers in the front seat.
Prater said he tried unsuccessfully to contact the Becerra family.
Although Paull has been cleared of all criminal charges, he still faces an administrative review by the Oklahoma City Police Department after an investigation determined Paull exceeded the speed limit while driving to the non-emergency call.
