OHP Trooper Faces No Charges Following Scuffle

The OHP Trooper involved in an altercation with a Creek Nation paramedic will not face criminal charges, Max Cook, the Creek County District Attorney, said.

OKLAHOMA CITY -- The OHP Trooper involved in an altercation with a Creek Nation paramedic will not face criminal charges, Max Cook, the Creek County District Attorney, said.

On May 24, Trooper Daniel Martin got into a scuffle with paramedic Maurice White on Highway 62, while a patient was being transported.

Cook said he made his decision based on dash camera video from the OHP vehicle and cell phone video of both incidents.

Cook's office conducted a thorough investigation, but Kenyada Davis, who captured the fight on his camera phone, said it wasn't enough.

"I don't work in the D.A.'s office and I don't know what he's thinking, but it would have been nice for him to at least get both sides of the story before he made his determination," Davis said.

It was his mother that was being taken to the hospital when OHP pulled over Creek Nation EMS for failing to yield. OHP Trooper Daniel Martin claimed Paramedic Maurice White was hostile and set the violent events in motion, but Davis said OHP was at fault and he's unable to come to terms with the District Attorney's decision.

"I'm really confused as to why there aren't any charges being pressed against the highway patrolman," Davis said.

Cook stands by the decision although he concedes the altercation could have been handled differently.

"We have emergency service providers who generally work well together and it was disappointing to see a situation where that clearly did not happen," Cook said.

Cook wouldn't release the dash-camera video that recording the alleged assault due to the investigation. Now that the investigation is complete, it remains up to OHP to release the footage.
