Teen Arrested After Deadly Shooting On Tulsa County Highway

Tulsa County, Oklahoma -

A 17-year-old girl is in jail and a 19-year-old man is dead after a rolling shootout on Highway 412 in Tulsa County. 

Investigators said this all started because 19-year-old Xaivier Foster knew the victim had bought a new gun, and he wanted to steal it. So, he recruited 17-year-old Mariely Lopez to help. 

Justin Green with the Tulsa County Sheriff's Office said Foster asked Lopez to set up a fake date with the victim and pick him up at his home.

"It's very sad...it's unfortunate that young people get mixed up in this," Green said. "We have a young man who lost his life, two others whose lives have been totally changed." 

Green said the victim and Foster started shooting at each other while Lopez was driving along Highway 412 in Sand Springs. 

All three people in the car were shot.

Investigators said Lopez lost control and crashed into the cable barrier after she was hit in the leg.

Green said the victim is lucky he was only shot in the leg, too.

"As many shots were fired inside the vehicle in a small space, two different guns being shot, a moving car....there's a lot of variables here that could have made the situation a lot worse," Green said. 

Foster died from his injuries. 

17-year-old Lopez is in the Tulsa County Jail facing a First-Degree murder complaint.

Green said he wants other teens to know if you commit an adult crime, you will face adult consequences.

"You know often times juveniles will commit crimes and they don't think it's a big deal because they are just going to go to juvenile court, or they are going to get a ticket, or are going to get community service," Green said. 

The victim is expected to recover.
