Police said surveillance footage shows that Rich hit the victim, Marc Brennan, intentionally.

They added he was walking in front of the vehicle when the truck suddenly accelerated and ran him over.

The timestamps on the video prove Rich waited 9 minutes before trying to get help, or have someone call 911, according to investigators.

Police said she also never tried to call 911 herself despite having a phone in her vehicle.

According to court records, witnesses also said Rich told them her boyfriend was "depressed" and "he tried to kill himself."

Meanwhile, Rich signed a statement that Brennen exited her truck because he was sick and needed to vomit.

Police said after watching the security footage, neither statement was true.

“The evidence we do have, reflects the charge filed. She has been charged with murder in the first degree,” said Pottawatomie County District Attorney Allan Grubb.

An affidavit revealed Rich told police the two spent $198 on their tab at the restaurant.

Rich was also blood tested, but the results have not been released.

She is being held with no set bond and will be in court December 15.
