An Oklahoma County Commissioner is suing the jail trust, which he is a member of.

Commissioner Kevin Calvey and the Oklahoma Second Amendment Association are asking a judge for a declaratory judgement ruling “Oklahoma is not a ‘sanctuary state’ like California” and that county policies are binding over the jail trust.

The jail trust was set to vote later this month on removing ICE from the county jail.

“To be able to have a full discussion or possible vote on this, we’ll have to wait to see what the Oklahoma County court determines,” Jail Trust Chairwoman Tricia Everest said.

Over the objection of protesters Monday, the board of county commissioners voted 2-1 reaffirming ICE support.

“I will never back down to bullies, anti-law enforcement, anti-American extremist like these protesters today,” Calvey told reporters after the vote Monday.

Commissioner Carrie Blumert voted against the policy and told News 9 she's seeking additional clarification and legal justification.

News 9 reached out to Calvey and the Oklahoma Second Amendment Association several times Friday but did not hear back.

Everest said whether ICE has an office in the jail or not, the jail would still cooperate with immigration officers.

“I wouldn't treat ICE any different than if the FBI were to call us or come in and said we have a person of interest that we’re holding,” She said. “I don't know the semantics of what that means.”

In the court filing, Calvey said the legal action is not intended to be hostile to the jail trust.
