Moore Police Officer Waives Preliminary Hearing In Case Related To Death Of Teen

Moore police officer Kyle Lloyd waived his preliminary hearing Thursday afternoon in front of Judge Scott Brockman.

In December, investigators alleged Lloyd caused a crash near Sooner Road and 134th Street that killed Moore High School Senior Emily Gaines.

Kyle Lloyd faced the Gaines family in court Thursday.

But neither he nor his attorney provided a comment about the case.

Emily’s family hoped details of the investigation would have come out, but the waiver of the hearing means a great deal of evidence is still not public record.

“It’s very hurtful. We still have a lot of unanswered questions, that will never be answered probably,” said Dana Gaines, Emily’s mother.

A lawsuit filed by family states Lloyd, a 13-year veteran of the department, was off-duty, but that he was still driving to assist a fellow officer at a Chick-Fil-A who had locked themselves out of their police vehicle.

The fellow officer was helping with a 'Shop With A Cop' event that was going on.

Emily's family argues Lloyd was going over 90 in a 50 mph zone, and that Lloyd was acting "under color of law" because he was helping a fellow officer.

They said that makes the department responsible.

Moore police said they would not comment on the case because of pending litigation.

Lloyd is now one step closer to a jury trial or plea.

“After he has waived preliminary hearing, the next step will appear before a district judge. For what they call formal arraignment,” said Travis White, First Assistant Cleveland County District Attorney’s Office.

Emily’s mother said her daughter is missed dearly each and every day.

She was a bright light to so many.

“I am ready for it to move forward. I was glad it was not delayed again. We are ready to have some closure,” said Gaines.

Lloyd is not in custody.

He previously bonded out and is on paid leave from the department.

The next court appearance has been scheduled for October 16 at 9:00 a.m.
