Natalie Fuston, a newborn baby girl, died last week and her father is in jail accused of abuse.

But the baby's grandparents said the mother could have stopped it.

James Ray Fuston, 22, was booked into the Oklahoma County Jail last week, but he is yet to be formally charged.

But the family of the baby's mother said she should be held accountable too.

“Her head was so swollen from brain swelling, just her whole head was bruised,” said Natalie’s grandmother, Barbara Morales.

Barbara Morales and her husband Hugo are still grieving the loss of their precious little granddaughter. They were in the delivery room the day she was born.  And said she would be alive today had their daughter stepped in and stopped the alleged abuse, or at least called someone for help.

“She said she saw him throwing her like this- that the baby would go six inches in the air. And I asked what did you do and she said I told him to stop but he's the father, that was her response,” said Barbara.

Court papers back up that story and state James Fuston at first tried to lie about what happened to the baby but later confessed. They also state the baby's mother and another relative warned him not to do it.

On April 7, baby Natalie was rushed to the hospital. Barbara said she can still remember watching her precious granddaughter as she fought to stay alive.

“I just crumbled. I looked at my daughter and said how, how could this happen?” said Barbara.

Six days after she was admitted into the hospital, baby Natalie died.

As police continue their investigation, Barbara wants them to take a closer look at her daughter.

“Think she is culpable in this, I think she was a part of it,” she said.

Barbara said they do plan on holding a candlelight vigil for baby Natalie Sunday, April 24, at a local park. And said her daughter is trying to raise money online for her funeral.
