Judge Will Not Release 911 Call In Bever Family Murders

A Tulsa County judge has decided not to release a 911 call made from the Bever family home the night five members were killed. The judge said the call was subject to the Open Records Act, but later said he wouldn't release the audio, only what the 911 operator typed that was said during the call.

The judge also ruled documents like search warrants and affidavits related to the case can be released to the media.

The Broken Arrow Police Department says it will send those out on Thursday.

Teenagers Robert and Michael Bever are accused in the killings, and their attorneys asked the judge not to release call made the night of the murders.

The call was made by the 12-year-old brother of Robert and Michael who later died. Police say he told them during the call his brothers were attacking the family.

The judge was deciding on whether to seal records in the case, which include the 911 call as well as documents police used to get search warrants. The judge decided to seal some very specific documents but heard arguments about whether to release the rest.

The attorneys for Robert and Michael Bever argued the 911 call is not an open record under the law, but the judge disagreed, saying it falls under the Open Records Act. The attorneys argued that the judge should not release it because it would have a damaging impact on their case.
