OKLAHOMA CITY -

A doctor accused of running a pill mill at Aria Orthopedics in Southwest OKC, fights to regain his ability to prescribe narcotics.

Dr. Harvey Jenkins is appealing a decision by the Oklahoma Bureau of Narcotics to suspend his license to prescribe controlled substances.

An administrative law judge is hearing evidence on both sides of the case.

After hours of witness testimony Dr. Jenkins and his legal team left OBN headquarters.

Five witnesses are set to testify during the appeal hearing, which include undercover OBN agents who acted as patients of Dr. Jenkins, and an investigator with the state medical board.

“And they are simply laying down the evidence that they found before the law judge as to why we took his license,” said OBN Spokesperson, Mark Woodward.

OBN has been investigating Dr. Jenkins for a while, even raiding Aria Orthopedics in late January where agents said they found several violations.

“Things like prewritten scripts that were left within the clinic, unsecure controlled drugs, as well as loose pills of controlled drugs,” said Woodward.

OBN then issued an "imminent danger" order, and immediately suspended Dr. Jenkins' license to prescribe controlled drugs in Oklahoma.

“I do not believe that Dr. Jenkins is guilty of any quote unquote, pill mill operation,” said Jenkins supporter, Dave Rowden.

Dave Rowden started the group, "Giving pain a voice in Oklahoma." He's also one of Dr. Jenkins patients.

“He's always been conscientious with me,” said Rowden.

About nine months ago, Rowden said he had a thorough discussion with Jenkins before he increased the dosage of one of his medications.

“A pill mill doctor would just write the prescription,” said Rowden. “There wouldn't be a four month discussion about it.”

The hearing will continue Thursday morning.

Dr. Jenkins still has his medical license. He's only prohibited from prescribing controlled drugs.

No criminal charges have been filed.
