Tuesday, the State has rested its case against a man accused of murdering another man during a road rage incident back in 2012 in Oklahoma City. 

Oklahoma City police's crime scene investigator Everett Baxter was back on the stand Tuesday morning, undergoing cross examination by the defense attorney representing David Bloebaum. Bloebaum stands accused of shooting and killing 29-year-old Jason Yousif on September 28, 2012.

Right now, it is unclear if Bloebaum will take the stand or plead the fifth in the murder trial against him. Attorneys for both the prosecution and the defense said they are still under a gag order and cannot comment on that.

The jury was asked to recess for a moment before lunch as new evidence was brought to the judge's attention. Subpoenaed medical records and doctor's notes from Northcare that were made during their treatment of the victim, Jason Yousif, were just received. And they were brought to the attention of the judge and the attorneys.

They were going to use them to cross examine one of the doctors who testified earlier, but that doctor is not going to be called back to the stand.

The prosecution rested its case at 12:15 p.m. Jury was asked to return at 1:40 p.m.

The defense made one last plea to the judge that this was an act of self-defense and should not go to a jury. The judge overruled the request.
