Charges have been dismissed against the former Erick Police Chief accused of assault.

Mike Day was accused of assaulting a shackled inmate at the Beckham County Detention Center and was arrested on the charge in April. He said Thursday he is ecstatic the charges were dismissed.

“They reviewed the video in real-time and they realized, there was no assault and battery,” Day told News 9.

Day found himself on the other side of the law when he was arrested for assault and battery involving an incident from December 2013. The charges were dropped at the end of August.

“I was hoping that charges would be dropped because, you know, I've got a lot of faith in the system,” Day said. “I'm just glad it finally is over.”

Court documents stated four jail staffers had said they saw Day either strike or push the inmate, but Day maintains he never hit the man.

“If I would have hit that man, there would have been injuries, I mean, the man is smaller than me,” Day explained.

Day said the inmate threatened his officer's life and his life, but all he did was help the inmate sit back down. He said only words were exchanged, no violence.

“I've been in the business for 30 years and I might be old, but I'm not stupid,” Day said.

Day told News 9 his name may be cleared of any charges, but his reputation has suffered.

“I've been a good cop. I've got a lot of accomplishments,” he explained. “Now this has tainted my reputation and it hurts.”

Day is now living in the Texas panhandle and is no longer working in law enforcement. He said he has not ruled out trying to go back into law enforcement one day.
