Off-Duty Arkansas Deputy Shoots, Kills Oklahoma Man

FORT SMITH, Arkansas -

Authorities have identified an Oklahoma man who was shot and killed by an off-duty Sebastian County sheriff's deputy in Fort Smith, Ark.

Police Sgt. Daniel Grubbs told the Times Record Sunday that 23-year-old Justin Wayne Higgins was killed in the Saturday afternoon shooting. Grubbs says Higgins was from the Muskogee and Wagoner county areas in Oklahoma.

Sheriff's Lt. Philip Pevehouse said previously that the deputy shot Higgins as Higgins tried to force another person to drive him from the scene in a pickup truck that had children inside. Pevehouse says Higgins allegedly pointed a gun at the deputy -- who said he heard the gun click before he fired.

Grubbs says Higgins had earlier exchanged gunfire with Fort Smith officers investigating a domestic disturbance report.

The names of the law officers were not immediately released.
