OKLAHOMA CITY -

A judge has denied a bail request for a man who is accused of hitting and killing another man with a bat during a baseball brawl in Oklahoma City.

Court document states Eric Noyola willfully and unlawfully killed Ricky Betancur with malice afterthought by hitting him in the skull with a baseball bat.

Noyola has been charged with first-degree murder. The District Attorney's office is also charging him with being drunk when he did it.

Eric Noyola's attorney asked if Noyola could be released on bail, saying that he had voluntarily surrendered himself when charges were upgraded to first degree murder, and that he has no past criminal history.

The District Attorney's office asked the judge to deny the request, citing state statutes on past first degree murder cases that do not allow for bond.

The judge denied the bail request Thursday morning.

More than two dozen friends and family members of Betancur were in the courtroom for Thursday's hearing, including Betancur's mother and father. One of his cousins, Amy Sanders, said they plan to be at every court hearing to make sure justice is service in Betancur's case, and to make sure Betancur is represented and remembered.

Coming up on News 9 at 6 p.m. Thursday, see Noyola in court and hear from Betancur's family.
