Police are investigating a homicide after a man was attacked in his southeast Oklahoma City home.

Police say the man was attacked by his Midwest City girlfriend. Court records show she has a violent past. She told police at the scene she'd gotten in a fight with her boyfriend. Now she sits in the Oklahoma County Jail.

Officers responded to a disturbance in the 1600 block of SE 52nd St. around 1:00 a.m. Tuesday. There they found 36-year-old Aisha Smith in a car trying to back out of the driveway. Police asked her what happened, and Smith told them she got in a fight with her boyfriend.

"When officers went inside they found the boyfriend, who has been identified as Walter Garland III. He did have trauma to his body," Sgt. Jennifer Wardlow said.

At this point, investigators aren't saying exactly how he was injured. Police reports show he was found sitting in a large pool of blood and was unresponsive. Paramedics took Garland to the hospital, where he died Wednesday morning.

None of Garland's neighbors would go on camera but, tell News 9 the couple had been together for a while and fought often. Police say they've responded to Garland's home nine times in just the past year.

News 9 found both Garland and Smith had filed protective orders against each other as recently as six weeks ago. Smith was arrested yesterday for assault with a dangerous weapon. Police say that will now be changed to first-degree murder.

This marks the 43rd homicide in Oklahoma City this year. The Medical Examiner will determine the cause of death.
