Charges against an Oklahoma City woman will be upgraded to first-degree murder after her boyfriend died following a domestic dispute.

Police were called Tuesday morning around 1 a.m. to a house in the 1600 block of 52nd Street in Oklahoma City. When officers arrived, they found 48-year-old Walter Garland had been seriously injured. He was rushed to a hospital, but died Wednesday morning.

Garland's girlfriend, 36-year-old Aisha Smith, was taken into custody Tuesday for domestic assault with a dangerous weapon. Police say now that Garland has died, charges against Smith will be amended to first-degree murder.

Police are not saying what killed Garland. His body will be taken to the Oklahoma Medical Examiner's Office for an autopsy.
