CASH FOR SCHOOLS: CONTEST RULES

$10,000 Giveaway

  1. The Contest is open to all U.S. citizens and legal U.S. residents at least 13 years of age except as otherwise provided in these or specific contest rules. For the purpose of this contest, individuals may live outside of the NEWS 9 DMA to cast a vote; however the school they vote for must be located within the NEWS 9 DMA. Individuals must meet the eligibility requirements outlined below to be eligible to participate in the vehicle portion of this contest as also outlined below.
  2. Only one prize of $10,000 may be awarded per school. Winning schools from the previous Cash for Schools contest are not eligible for this contest. Prizes will be provided by NEWS 9 & Norman Chrysler Jeep Dodge.
  3. How to win.  One Oklahoma high school within the NEWS 9 DMA will be selected each week, for four weeks, and will be awarded $10,000. Winner will be selected based on the highest number of votes, as collected by the online contest entry form or via the alternative method of entry, the Cash for Schools: Official Alt Entry form. A single winning school will be determined from the votes received by NEWS 9 by the following deadlines: April 19, 2012 at noon, April 26, 2012 at noon, May 3, 2012 at noon, and May 10, 2012 at noon. Votes will continue to accrue during the entire course of the contest. A school cannot win twice. Prizes will be provided by Norman Chrysler Jeep Dodge and NEWS 9.
  4. How to enter. Participants may enter the Cash for Schools contest by completing the online contest entry form (the primary form of entry) at www.News9.com/CashforSchools - or - by mailing or delivering the official alternative method of entry, the Cash for Schools: Official Alt Entry Form (http://ftpcontent.worldnow.com/kwtv/custom/cashforschools/CashForSchoolsAltEntry.pdf) to NEWS 9: Cash for Schools, 7410 N Kelley Avenue, Oklahoma City, OK 73111. Entries must be received at www.News9.com/CashforSchools and the NEWS 9 business office no later than the deadlines outlined above. (See No. 3) Only one entry (by either online form or Official Alt Entry Form) will be accepted per day per person. Only the Official Alt Entry Form entries will be accepted via mail or hand delivery. Photocopies, facsimiles or other reproductions will not be eligible. If a high school that participated in a previous round of the Cash for Schools giveaway isunaware of the updated official alternate entry and submit votes that were considered valud during such previous contest, those votes will be counted.  However, all vote going forward must use the official alternate entry form.
  5. Prizes. Four prizes of $10,000 will be awarded and provided by Norman Chrysler Jeep Dodge and NEWS 9.
  6. The Contest is void where prohibited by law.
  7. No purchase, registration fee or donation of money is required to register or win.
  8. "Contest Officials" designated by the management of NEWS 9 shall be responsible for selection of winners and for interpretation and enforcement of the contest rules.
  9. By participating in this Contest, all entrants agree:  (a) to abide by these and any additional specific official rules and the decisions of the Contest Officials, which will be binding and final in all respects; (b) to the use of information by the Contest Entities for marketing and advertising purposes as allowed by applicable privacy policies and law; (c) to indemnify, defend, and hold harmless the Contest Entities and their officers, directors, employees and agents from any and all liability, claims, lawsuits, costs, expenses or fees, for copyright, trademark or other intellectual property claims, claims for injuries (including death), losses, and damages resulting or alleged to result from participation in the Contest, acceptance or use of any prize, and/or from entrants' fraudulent or otherwise wrongful acts or omissions; (d) not to upload or attach files that contain software or other material protected by intellectual property laws (or by rights of privacy of publicity) unless they own or control the rights thereto or have received all necessary consents; (e) not to upload or attach files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of another's computer; (f) not to sue the Contest Entities for any damages alleged to arise from winner's acceptance of or use of the prize(s); and (g) to the use of the entrant's, name, voice, biography, and likeness by Contest Entities without further notice or compensation for promotional or advertising purposes, except where otherwise prohibited by law.
  10. Contest Officials shall have the sole right to disqualify any participant for violation of these rules or any other published rules applicable to a specific contest, and to resolve all disputes in their sole discretion.  Contest Entities (a) make no warranty, guaranty or representation of any kind concerning any prize; (b) disclaim any implied warranty and (c) are not liable for injuries, losses or damages arising or alleged to arise out of any persons participation in the Contest.  All disputes will be resolved under applicable Oklahoma laws.
  11. Contest Entities are not responsible for lost, stolen, late, damaged, misdirected, undelivered, undeliverable, incomplete or unreadable entries. Contest Entities are not responsible for lost entries due to telephonic or electronic malfunctions.  Contest Officials may prohibit an entrant from participating in the Contest or winning a prize if, in their sole discretion, it is determined that said entrant is attempting to undermine the legitimate operation of the Contest by cheating, deception, or other unfair playing practices or intending to annoy, abuse, threaten, or harass any other entrants or Contest Entities representatives. If for any reason this Contest is not capable of running as planned as a result of any causes beyond the reasonable control of Contest Entities including but not limited to tampering, unauthorized intervention or fraud which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Contest, then, Contest Officials reserve the right at their sole discretion to cancel, terminate, modify, or suspend the Contest. The rules can be modified at any time without notice.
  12. NEWS 9 reserves the right, in its sole discretion, to cancel or suspend the Contest for any reason.
  13. Winning schools will be notified by telephone. Winner(s) must sign and return a Statement of Prizewinner provided by NEWS 9. NEWS 9 reserves the right to require additional identification and may choose to deny awarding the prize based on falsification of identification or fraud. 
  14. If the winning school cannot be notified within one day of the winner selection, does not timely return the signed Statement of Prizewinner or for other reasons set forth in these rules, is determined not to be an eligible winner, the prize(s) will be awarded to an alternate winner.
  15. No transfer, substitution, or cash equivalent for prizes will be allowed except at the Contest Entities' sole discretion due to prize unavailability.  All federal, state, or other tax liabilities (including income taxes), and subsequent or related expenses such as, but not limited to, gasoline, insurance, and maintenance arising from the award of a prize from this Contest will be the sole responsibility of each prize winner.  Any prize awarded in this Contest must be claimed within 1 (one) week of winner's notification by NEWS 9 or sooner, depending upon the specific prize or contest.

The Contest is open to all U.S. citizens and legal U.S. residents at least 13 years of age, who reside in the NEWS 9 Designated Market Area, as defined by Nielsen Media Research, Inc. except as otherwise provided in these or specific contest rules.  Employees of Griffin Communications, L.L.C. and its affiliated parent and subsidiary companies, affiliated stations or companies, advertising and promotion agencies, sponsors, entities furnishing prizes or otherwise connected with the conduct of this Contest ("Contest Entities") and their respective officers, directors, representatives and agents, their immediate families and members of their households, are all ineligible and may not register for or participate in the Contest.
  2. Only one prize may be awarded per household. Winners from other contests sponsored or conducted by NEWS 9 within thirty (30) days preceding the beginning of this contest are not eligible for this contest. Prizes will be provided by Norman Chrysler Jeep Dodge.
  3. How to win.  You are automatically entered for a chance to win when you complete the Cash for Schools online entry form or the alternate form of entry. Only one entry will be allowed per person per day. Four finalist names will be selected by random number generator and will be read on air during News 9 This Morning, Monday thru Friday, anytime from 5-7am CT, April 18-May 18, 2012. Finalists have until 7:30am CT the same day that their name is read on-air during News 9 This Morning, to call the designated number also indicated on-air when their name is read to "claim" their chance. If a finalist does not "claim" their chance before the deadline they will not be able to "claim" their chance at any other time and they will not be eligible to be a finalist again. Winners will be selected by random number generator throughout the course of the contest from a list of finalists who have "claimed" their chances. Contest officials reserve the right to distribute additional chances as deemed necessary.

1 YR VEHICLE WALKAWAY: Additional Rules

  1. The vehicle which Winner or Winner's Designate (as defined below) shall be taking possession of will be a 2012 Dodge Caliber in a color and trim package to be determined by Norman Chrysler-Jeep, Inc. (hereinafter the "Automobile").
  2. In order to accept possession of the Automobile, Winner or Winner's Designate (as defined herein) must be at least eighteen (18) years of age or older, must be able to verify their identity, and must satisfy all requirements listed herein or otherwise subsequently determined (i.e. appropriate driving record).
  3. In the event that Winner is eighteen (18) years of age, then they MUST be the individual accepting possession of the Automobile.  In the event that Winner is eighteen (18) years of age or older, but otherwise excluded from taking possession for whatever reason (i.e. unacceptable driving record, etc.), then the Automobile shall not be delivered to Winner, and Winner shall not have the right to designate an alternate individual to accept possession of the Automobile ("Winner's Designate").
  4. In the event that Winner is under eighteen (18) years of age, then they shall be entitled to designate an alternative individual to accept possession of the Automobile ("Winner's Designate"). Such Winner's Designate MUST be eighteen (18) years of age or older, must be Winner's legal guardian, must live in the same household as Winner, and shall be subject to the same requirements as Winner in order to accept possession of the Automobile (i.e. appropriate driving record, etc.).  In the event that Winner's Designate is excluded from taking possession of the Automobile for whatever reason (i.e. inappropriate driving record, etc.), then the Automobile shall not be delivered to Winner or Winner's Designate, and neither Winner nor Winner's Designate shall have the right to designate an alternative individual to accept possession.
  5. Winner or Winner's Designate must have a valid Oklahoma driver's license that is in good standing at the time of the acceptance of the Automobile, and such license must remain in good standing for the full time of Winner or Winner Designate's possession of the Automobile.  In the event that Winner or Winner's Designate does not have a valid driver's license, then Winner and Winner's Designate shall be excluded from taking possession of the Automobile, and neither Winner nor Winner's Designate shall have the right to designate an alternative individual to accept possession.  Further, if following accepting possession of the Automobile, Winner or Winner's Designate shall for any reason lose the valid status of their driver's license then the same shall be considered a default and M&N Dealerships Finance, Inc. and/or Norman Chrysler-Jeep, Inc. shall have the right to repossess the Automobile.
  6. Winner or Winner's Designate understands and acknowledges that the Automobile shall only be driven for up to fifteen thousand (15,000) miles during the first year of Winner or Winner Designate's possession of the Automobile.  In the event that mileage in excess of that allowed on the Automobile is incurred, then Winner or Winner's Designate understands that they shall be required to pay M&N Dealerships Finance, Inc. or Norman Chrysler-Jeep, Inc. a charge of fifty cents ($0.50) per mile in excess of fifteen thousand (15,000) miles.
  7. It is understood and agreed that the Automobile will actually be purchased by Winner or Winner's Designate from Norman Chrysler-Jeep, Inc.  The purchase will be financed through M&N Dealerships Finance, Inc. for a price of seventeen thousand five hundred ninety four dollars and fifty cents ($17,594.50), at a term of thirty six (36) months, and an interest rate of 4.9%, resulting in a monthly payment of five hundred twenty six dollars and fifty four cents ($526.54).  However, the first full year of said payments shall be made by Norman Chrysler-Jeep, Inc.  Payments shall be made for the entire year at the time of purchase.  Further, at the end of the first year then Winner or Winner's Designate shall have the right to: 1) opt-out of the remaining term, return the vehicle, and no further payments shall be due and owing, or 2) make a lump sum payment of thirteen thousand five hundred dollars ($13,500.00) to M&N Dealerships Finance, Inc., and accept title to the Automobile free and clear of any liens or other encumbrances.  In the event that Winner or Winner's Designate desires to obtain financing for the lump sum payment, then M&N Dealerships Finance, Inc. and Norman Chrysler-Jeep, Inc. shall use their best efforts to assist Winner or Winner Designate in the process of evaluating and arranging financing for said party.
  8. It is further understood and agreed that Winner or Winner's Designate shall be responsible for titling, tagging, and paying excise tax on the Automobile within thirty (30) days from the date of accepting possession of the Automobile.  However, any expense to do the same on the part of Winner or Winner's Designate shall be reimbursed by Norman Chrysler-Jeep, Inc.  Failure to title, tag, or pay excise tax shall be an event of default and M&N Dealerships Finance, Inc. shall have the right to repossess such Automobile.
  9. It is further understood and agreed that Winner or Winner's Designate shall be responsible for paying for collision insurance with a deductible not to exceed one thousand dollars ($1,000.00) on the Automobile prior to accepting possession of the Automobile.  However, any expense to do the same on the part of Winner or Winner's Designate shall be reimbursed by Norman Chrysler-Jeep, Inc.  Failure to insure the Automobile at any time during Winner or Winner's Designate's possession of the Automobile shall be an event of default and M&N Dealerships Finance, Inc. and/or Norman Chrysler-Jeep, Inc. shall have the right to repossess such Automobile.
  10. In the event that the Automobile is damaged, and the insurance purchased by Winner or Winner's Designate is used, then neither M&N Dealerships Finance, Inc. nor Norman Chrysler-Jeep, Inc. shall be responsible for reimbursing the deductible amount.
  11. In the event that the Automobile is totaled, then neither M&N Dealerships Finance, Inc. nor Norman Chrysler-Jeep, Inc. shall be responsible for replacing the Automobile or otherwise providing Winner or Winner's Designate with another automobile.
  12. Winner or Winner's Designate agrees and understands that they will be required to bring the Automobile into Norman Chrysler-Jeep, Inc.'s place of business every three (3) months or three thousand (3,000) miles, whichever occurs first.  At such time, routine maintenance (including, but not limited to, oil changes) shall be performed on the Automobile at no expense to Winner or Winner's Designate.
  13. It is further specifically understood that Winner or Winner's Designate shall be obtaining a taxable benefit such that they will receive an Internal Revenue Service Form 1099 outlining such benefit.
  14. It is specifically understood that M&N Dealerships Finance, Inc. and/or Norman Chrsyler-Jeep, Inc. shall maintain a security interest in the Automobile to be driven by Winner or Winner's designate.  It is further specifically understood and agreed that such security interest shall remain a first and priority security interest.  In the event that Winner or Winner's designate attempts to attach or otherwise place another security interest on the Automobile, then M&N Dealerships Finance, Inc. and/or Norman Chrysler-Jeep, Inc. shall have the right to repossess the Automobile.
  15. In order to receive possession of the Automobile, Winner or Winner's Designate shall provide sufficient proof that they have never been detained, arrested, plead no contest to, or convicted of the following criminal offenses: driving under the influence of alcohol, driving under the influence of narcotics, driving under suspension, reckless driving, joy riding, possession of a controlled dangerous substance, theft of an automobile, or any other crime that Norman Chrysler-Jeep, Inc. (in its sole and absolute discretion) determines would make either the Winner or Winner's designate an unfit person to receive such Automobile.
  16. Winner and Winner's Designate agree that they are specifically responsible for making certain that all parking laws and regulations are complied with.  In the event that any parking ticket goes unpaid past its due date, then the same shall be an event of default and M&N Dealerships Finance, Inc. and/or Norman Chrysler-Jeep, Inc. shall have the right to enforce their security interest and repossess the Automobile.  In the event that the Automobile is impounded for whatever reason, then the same shall be an event of default and Norman Chrysler-Jeep, Inc. shall have the right to enforce their security interest and repossess the Automobile.
  17. In the event that Winner, Winner's designate, or any other individual driving the Automobile receives a violation of any Federal, State, County, or Municipal ordinance; then M&N Dealerships Finance, Inc. and/or Norman Chrysler-Jeep, Inc. shall have the right in their sole and absolute discretion to deem the same an event of default and accordingly they shall have the right to enforce their security interest and repossess the Automobile.
  18. M&N Dealerships Finance, Inc. and/or Norman Chrysler-Jeep, Inc. shall have the right to request periodic inspections of the Automobile to make certain that the same is being properly maintained and otherwise cared for so that the value of the Automobile is not being negatively affected.  Such inspections shall be performed at Norman Chrysler-Jeep, Inc.'s place of business during normal operating hours.  Such inspections shall be determined from time to time, and Norman Chrysler-Jeep, Inc. shall make reasonable accommodations to accommodate Winner or Winner's Designate's schedule.
  19. In the event that Winner or Winner Designate fails to properly maintain the Automobile or otherwise takes, or fails to take, any action that M&N Dealerships Finance, Inc. and/or Norman Chrysler-Jeep, Inc. in its sole and absolute discretion deems to negatively affect the value of the Automobile; then such act, or failure to act, shall be deemed an event of default and Norman Chrysler-Jeep, Inc. shall have the right to enforce their security interest and repossess the Automobile.
  20. Any cause of action that may arise or accrue between Winner, Winner's Designate, any heir, assign, or relative of Winner or Winner's Designate and M&N Dealerships Finance, Inc. and/or Norman Chrysler-Jeep, Inc. shall be submitted to binding arbitration and conducted pursuant to the Federal Arbitration Act.
