Three Alleged Victims In Child Sex Case Against Former OU Professor

NORMAN, Oklahoma -- An attorney for Dwain Pellebon, a former University of Oklahoma professor, said there are three alleged victims in the case against his client. Dwain Pellebon resigned from OU last week after he was charged of child sex crimes. He was charged with two counts of rape in the first degree, two counts of child sexual abuse by lewd acts and two counts of lewd acts with a child under the age of 16.

"They're very serious," said David Smith, who is representing Pellebon. "They're not something to take lightly. There were two additional charges that we hadn't anticipated that were added."

Those two charges were the two counts of lewd acts with a child under 16-years-old. Smith said each of those charges deal with different victims that the other charges.

"I personally don't think that anything will come of them," explained Smith. "If you look at the affidavit, it doesn't even allege a crime there. It's not a crime to touch a child. It's not a crime to feel affection for a child. You go home and pat your kid on the head, you're not committing a crime."

Wednesday, Smith said he is depending on the children's testimony to get the lewd acts charges dismissed.

"We anticipate that the two young people in particular, will say there was nothing sexual about this," Smith said.

The four additional counts Pellebon faces are a little more tricky for the defense. Smith said Pellebon was very open and honest with investigators to the point that his words could be twisted and used against him. In addition, he has not been able to see the interviews with the witness involved in those four counts.

"We haven't had a chance to interview the complaining witness on those counts," said Smith. "It's important, especially with the interviews with the children, it's important to actually see them say what they said. We not only hear the words, we see how they said it."

Smith said he does not anticipate getting those tapes for at least another week. The next step in this case will be a preliminary hearing conference scheduled for January 3. Pellebon was out on a $75,000 bond. A stipulation of that bond is that he does not come in contact with minors.
