OKLAHOMA CITY -- An attorney for an Oklahoma City pharmacist charged with first-degree murder in the death of a teenage robber says the prosecutor in the case should be removed.
Oklahoma County District Judge Ray Elliott will hear legal arguments Tuesday in the case of Jerome Ersland. Ersland is charged in the May 2009 shooting of 16-year-old Antwun Parker at the Reliable Discount Pharmacy.
Ersland has said he shot the unarmed Parker once in the head in self-defense. District Attorney David Prater says Ersland went too far when he fired five more shots into Parker, who was already unconscious.
Ersland's defense attorney, Irven Box, filed a motion last month to remove Prater from the case. Box says he has made the prosecution of Ersland personal.
