OKLAHOMA CITY -- Oklahoma's interim Chief Medical Examiner released his opinion on the death of a would-be robber just three weeks before the pharmacist who shot him goes to trial.

Jerome Ersland is accused of killing 16-year-old Antwun Parker at the Reliable Pharmacy.

Interim Chief M.E. Doctor Andrew Sibley said Parker was 'almost certainly' alive after being shot with the first bullet in the head and falling to the ground.

Surveillance video showed Ersland firing five more shots into the teen.

But Sibley also said despite being unconscious, "it is conceivable that involuntary movement may be perceived as a continued threat."

Ersland's lawyer said the new report enhances his defense. District Attorney David Prater has not yet responded to Monday's report release.

All parties will be back in court Thursday where the defense will ask a judge to throw out the case.
