Appeals Court Rejects Convicted Killer's Appeal

A federal appeals court in Denver has rejected an appeal filed by a convicted killer from Oklahoma.

OKLAHOMA CITY -- A federal appeals court in Denver has rejected an appeal filed by a convicted killer from Oklahoma.

The U.S. 10th Circuit Court of Appeals on Thursday dismissed the appeal by 44-year-old Darrin Lynn Pickens, who represented himself.

Court records show Pickens was twice convicted by an Oklahoma jury and twice sentenced to death for the 1990 killing of store clerk Tommy Hayes during a robbery in Creek County. The Oklahoma Court of Criminal Appeals vacated Pickens' second death sentence and modified it to life in prison without parole.

In his latest appeal, Pickens argues among other things that the warrant for his arrest was illegally obtained, that he was denied his right to counsel and there was insufficient evidence linking him to the crime.
