NORMAN, Oklahoma -- Closing arguments in a triple murder trial have been postponed until Wednesday.

Billy Davis, 52, is charged with killing three women with a shotgun at a Norman residence in September 2007.

Lawyers spent so much time in the judge's chambers going over jury instructions that the judge decided to send the jury home and start fresh Wednesday.

Defense attorneys said Davis' alcoholism and bipolar disorder rendered him incapable of forming intent to kill.

After listening to arguments, the judge decided the jury could not legally convict Davis of manslaughter. The jury's only choices will be murder in the first degree or murder in the second .

Prosecutors are seeking the death penalty.
