Ditata's Granite... What Now?

If you are a customer of Ditata's Granite who has lost money, I truly feel for you!  With them filing for bankruptcy, it is not looking good in regards to you seeing your money.  But I want to pass along all the information I have in case you want to try everything possible to recover it.

As I mentioned, they filed bankruptcy.  The way this works is they will have to go before a trustee and answer to the debt that they have.  If you're owed money there is a list of creditors (probably with your name on it).  Click here to see the current list as of February 11th. That will be brought up in court.  If your name is not on the list, here's what to do:
The bankruptcy court has a form called "Proof of Claim".  You need to fill it out.  Click here to access it.
You can then print it off and mail it, along with statements showing what is owed to:

You may also want to attend the bankruptcy hearing for creditors.  Currently it is scheduled for March 2 at 4pm on the first floor, room 119 at 215 Dean McGee Avenue in OKlahoma City.  As it gets closer, call the Western District's Bankruptcy Court at 405-609-5700 to double check on dates and times.

Ditata's attorney also brought up something that's new to me.  He says by federal bankruptcy law, even if his clients could, they're not allowed to give money back to clients.  He says that's considered preferential treatment if you have more than 1 creditor.  He also says the law states that anyone who was paid back within the 90 days prior to filing for bankruptcy is at risk of having the court require them to return the money to the trustee so that it can be distributed equally.
